Customer: the natural person who is not acting in a professional or commercial capacity and enters into an agreement with Soolzter.
Order: an order placed by Customer according to the defined procedure for the supply on one or more products.
Product: a product offered for sale on the website by Soolzter.
Purchase price: the price of a product indicated on the website in Euros inclusive of VAT and exclusive of shipping costs.
Agreement: the Order by Customer that is accepted as such by the vendor.

 

ARTICLE 1. APPROPRIATENESS OF THE GENERAL TERMS AND CONDITIONS

1.1

These General Terms and Conditions are applicable to all orders, offers, agreements and other legal relationships between Customer and Soolzter with regard to the use of the website.

The General Terms and Conditions can be consulted via soolzter.com.

 

ARTICLE 2. FORMATION OF THE AGREEMENT

2.1

All offers made on the website of Soolzter are free of engagement until the purchase agreement is concluded.

An agreement between Customer and Soolzter shall only be concluded when Soolzter accepts Customer’s Order. Customer has completed the entire Order procedure via the website. When Soolzter has accepted the Order, Soolzter shall send an Order confirmation to Customer by e-mail as soon as possible after the Order has been placed.

 

2.2

Soolzter reserves the right, among other things, not to accept orders placed by Customer if:

  • The data entered by Customer are incorrect and/or incomplete.
  • Payment by Customer is not received within the agreed term.

 

Soolzter shall notify Customer as soon as possible if the Order cannot be accepted.

 

 

ARTICLE 3. IMAGES

3.1

All data and images regarding dimensions, colours etc. of the products offered are merely an approximation and may not constitute any reason for compensation and/or dissolution.

 

 

ARTICLE 4. MEANS OF DELIVERY AND DELIVERY PERIODS

4.1

Deliveries will be carried out by PostNL

 

4.2

After the Agreement has entered into effect, Soolzter shall dispatch the shipment to the address specified by Customer as soon as possible, provided Soolzter has received the full purchase price. Soolzter endeavours to deliver the products within 2 days following receipt of payment.

 

4.3

Delivery periods stated by Soolzter are indicative. Exceeding any delivery period does not give Customer any right to compensation or the right to cancel or dissolve the Agreement, unless the delivery period is exceeded in more than 30 days and Customer cannot reasonably be expected to leave the Agreement intact. In such a case Customer is authorised to cancel or dissolve the Agreement to the extent necessary.

 

4.4

The delivery period indicated for the products commences as soon as Soolzter receives the payment from Customer.

 

4.5

The risk relating to damage or absence of the products is transferred to Customer at the moment of delivery. Customer shall bear the risk of any return shipment of the products.

 

 

ARTICLE 5. PRICE AND PAYMENT

5.1

Prices indicated on the website are expressed in Euros inclusive of VAT and exclusive of shipping costs. Shipping costs are charged for each individual agreement. When the Order is placed and the Agreement is confirmed, the total payable purchase price will be displayed.

 

5.2

Soolzter may adjust the prices indicated on the website without any specific notification being necessary. The prices indicated at the time the Order is placed shall be the prices that form part of the Agreement.

 

5.3

Payment shall be effected via MultiSafePay or PayPal. MultiSafePay offers facilities for effecting payment via iDEAL, Mastercard, Visa, Maestro, bank transfer, Mister Cash, Giropay and DIRECTebanking. Both in the case of MultiSafePay and PayPal, you are briefly redirected to the relevant payment screen of the aforementioned organisations.

 

5.4

Customer is obliged to notify Soolzter of any inaccuracies in the payment information he has provided to Soolzter.

 

 

ARTICLE 6. RIGHT TO RETURN THE PRODUCT

6.1

Customer has the right to return the supplied product within a period of 14 days from receipt of the product without stating the reason, provided the product has not been worn (clothes may be tried on for size), are undamaged and in their original packaging. Customer shall notify Soolzter if this in writing by e-mail within seven days.

The total amount is returned to Customer’s account within seven days from receipt of the return shipment. All shipping costs shall be for Customer’s account, as shall be the risk of return shipment.

 

6.2

Soolzter reserves the right not to accept returned products or not to credit the total amount if it suspects that the article has already been used, or if has been damaged by Customer.

 

 

ARTIKEL 7. GIFTCARDS

7.1

These General Terms and Conditions are applicable to all giftcards issued by Soolzter. 

 

7.2

Each giftcard has a unique code. This is a combination of numbers and letters. The giftcard and code should be carefully preserved. In case of theft including the use of the code by unauthorized third parties, or loss of the giftcard there wil be no refund. Only original giftcards and codes can be used and must be provided upon request. Soolzter reserves the right to accept a gift certificate only after the receipt of the original giftcard and in case of improper use to demand payment in money.

 

7.3 

A Soolzter giftcard can be exchanged after the desired items are selected and added to the 'shopping cart'. During the order process you can enter the discount code.

 

7.4

All gift certificates are valid for one year.

 

7.5

You cannot obtain any cash advance with your Gift Card or redeem your Gift Card for cash.

 

7.6

Giftcards don't need to be spent at one time. The outstanding amount will continue to be available under the same code for one year.

 

7.7

If the total amount exceeds the value of the giftcard, the difference has to be paid by one of the other payment methods.

 

7.8

On the basis of article 6.1 in these general conditions Soolzter will refund (part of) the invoice paid and this amount will be charged back to the giftcard. The amount paid is through another payment method (credit card, Paypal, etc.) will be charged back to the customer.

 

7.9

Any (attempt to) fraud or other unauthorized act is registered and will result in the use of gift cards is denied.

 

 

ARTICLE 8. COMPLAINTS

8.1

Customer shall inspect the product on delivery and to notify Soolzter within three days following receipt for visible defects or other complaints concerning the performance of the Agreement. Such complaints must be made clearly and fully in writing, stating the reasons for this.

 

8.2

Customer acknowledges that minor deviations in the product and/or product deviations in quality, size, colour, finish etc. that are qualified as acceptable in the trade or that are technically difficult or impossible to prevent shall not constitute a valid reason for complaint. Such complaints and complaints regarding the fact that certain articles have been withdrawn from the product range, are invalid. Soolzter is not liable for damage suffered by Customer on account of such complaints.

 

  

ARTICLE 9. INTELLECTUAL PROPERTY RIGHTS

9.1

Soolzter owns and retains all intellectual property rights that are or may be vested in the website. This shall include, among other things, the design, naming, logo, text, photos, videos, illustrations etc.

 

 

ARTICLE 10. WARRANTY AND LIABILITY

10.1

Soolzter shall not be liable for any indirect, additional or consequential damage of any kind whatsoever that Customer may sustain in connection with the Agreement. Any direct damage for which Soolzter may be liable by law vis-à-vis Customer shall never exceed the selling price.

 

 

ARTICLE 11. CONFIDENTIALITY

11.1

Soolzter shall store the personal data provided by Customer in the customer database and shall use said data in the processing of the Order. Soolzter shall not disclose any customer data to third parties without Customer’s permission.

 

 

ARTICLE 12. GOVERNING LAW

12.1

The Agreement between Customer and Soolzter shall be governed by the laws of the Kingdom of the Netherlands.

 

 

ARTICLE 13

13.1

If any provision of these General Terms and Conditions should prove to be invalid:

  • the remaining provisions will continue to apply in full force; and
  • the invalid provision shall be interpreted as or replaced by another provision reflecting as closely as possible the original intention.

 

 

ARTICLE 14

14.1

These General Terms and Conditions may be amended by Soolzter. The most recent General Terms and Conditions shall be published on the website. Customer shall always consult these General Terms and Conditions before Customer uses the website. If the General Terms and Conditions cannot be consulted via the internet, Soolzter may on request provide Customer with the most recent version of the General Terms and Conditions by e-mail.
